1. Scope of Application

This Privacy Policy is valid from 19th of October 2021. Protecting SEEBURGER website users’ personal data is very important to SEEBURGER. This Privacy Policy governs the collection, processing and use of personal data related to your visit on this website.

2. Responsible Body

SEEBURGER AG (Email privacyspam prevention@seeburger.com, Phone +49 7252/96-0, Edisonstrasse 1, 75015 Bretten, Germany) is the responsible body under the European Union General Data Protection Regulation (EU-GDPR), the German Federal Data Protection Act (BDSG) and the service provider under the German Telemedia Act (TMG).

3. Collection, Processing and Use of Personal Data

We collect and use personal data of our users insofar as this is necessary to provide a functional website as well as to provide our contents and services. The collection and use of our users' personal data is regularly carried out with the user's consent. An exception applies in those cases where prior consent cannot be obtained for valid reasons and the processing of the data is permitted by law and within our legitimate interest.

Legal basis for the storage of data is Art. 6 para. 1 cont. of the EU-GDPR.

When you visit our website, we collect, process and use certain data for precisely defined purposes. The data that we regularly collect and process during your visit to our website includes the name of your Internet Service Provider (ISP), the website through which you visit us, the websites of SEEBURGER AG that you have viewed, websites which you visit from the SEEBURGER website, your IP address and the date and duration of your visit. We process this data in a non-personalized form and store and analyze it exclusively for statistical purposes so that we can continuously improve our websites and our range of products and services.

We collect personal data if you voluntarily provide it, for example as part of your registration for newsletters, events, product information or for processing other inquiries addressed to us. This is data that you enter using provided forms so that we can interact with you. We use this data to respond to your inquiries and to inform you as required about our product and service offerings. In addition, we use the data to provide you with personalized information for marketing purposes through various communication channels (for example, when registering for our newsletter).

Insofar as we involve third parties in the context of the collection, processing and use of your data as a service provider for SEEBURGER AG, we limit the disclosure to the data to the extent, which is necessary for the delivery of the service ordered by us. In doing so, we will commit the respective service provider in writing to use your data exclusively on our behalf and exclusively in the context of the purpose agreed between you and us. Furthermore, the respective service providers are obliged by us to respect data privacy and are not authorized to disclose your data or to use it for purposes other than the ones assigned by us.

We may use legitimate interest as legal basis in countries where this is applicable using your personal data for e.g. to improve our services, for statistical purposes or business development purposes such as marketing to provide you with details of our services and solutions in newsletters, invites to seminars and events.

In case you have given SEEBURGER your email address for communication or direct marketing purposes, SEEBURGER will process personal data in order to communicate with you. Such processing of personal data for direct marketing purposes takes place on the legal basis of your consent or our legitimate interest in direct email communication in countries where this is applicable. 

We will provide an option to unsubscribe or opt-out of further communication on any electronic marketing communication sent to you, explained in section 9.4. “Right of information, objection and revocation” or you may opt out by contacting us as set out in section 8.4. “Right of information, objection and revocation”

4. Safekeeping of Data

The personal data of the person concerned will be deleted or blocked as soon as the purpose of storage ceases to apply. Furthermore, data may be stored due to applicable European or national regulations, laws or other provisions. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.

5. Use of Cookies and Web Analysis Tools

We use cookies for our SEEBURGER website. Cookies are small text files that are sent to your browser by our web servers during your visit to the SEEBURGER websites and that are saved by your browser on your computer for retrieval later on.

YOU CAN DEFINE WHETHER COOKIES CAN BE PLACED AND RETRIEVED THROUGH YOUR BROWSER SETTINGS. For example, you can completely disable the saving of cookies, restrict the action to specific websites, or configure your browser to notify you automatically when a cookie is to be set and request a response from you.

We use both session cookies (also called temporary cookies) and permanent cookies on our SEEBURGER websites. Session cookies are only cached while you are using one of our websites. These cookies are used to identify your computer during a visit to our websites and to determine when your visit ends. For technical reasons, you must permit the use of session cookies in order to take advantage of all the features and functions on our websites. Session cookies are deleted as soon as you leave the website or close your browser.

In addition, we use permanent cookies to identify returning visitors, even if they have not visited the site for a long time, so that we can provide them with information on our products and services based on their needs. Permanent cookies are permanently saved on the user’s computer and are not deleted when you leave the website or close your browser. Permanent cookies need to be deleted manually.

We also use cookies as part of web analysis services, which we use to obtain information on how you interact with our websites. This includes gathering standard information that your browser sends to our websites, such as browser type, access times, or the address of the website which has forwarded visitors to our website etc. If you enter personal data on any of our websites, we will use this data to provide you with targeted and personalized information on our products and services, to the extent permitted by your declaration of consent. As described above, you can of course revoke your consent at any time with effect for the future.

6. Google Analytics

6.1 General

We also use Google Analytics, a website analysis service by Google Inc. (‘Google’). Google Analytics uses cookies. The information on your use of our websites generated by these cookies is generally sent to and saved on a Google server in the USA. IP ANONYMISATION IS ACTIVATED ON OUR WEBSITES. This means that Google will first compress your IP address within the member states of the European Union or in other parties to the Agreement on the European Economic Area. The full IP address is only transferred to a Google server in the USA and compressed there in exceptional cases. On behalf of SEEBURGER AG, Google uses this information to analyze your use of our websites, prepare reports on your activities and provide additional services for SEEBURGER AG related to your use of our websites. The IP address transmitted by your browser as part of Google Analytics is not merged with other data collected by Google.

We use Google Signals. When you visit our website, Google Analytics collects, among other things, your location, search history and YouTube history, as well as demographic data (visitor data). This data can be used for personalized advertising with the help of Google Signals. If you have a Google account, Google Signal's visitor data is linked to your Google account and used for personalized advertising messages. The data is also used to create anonymized statistics on the user behavior of our users.

6.2 Google Tag Manager

We use Google Tag Manager to efficiently manage and implement various tracking and analysis tools on our website. The Google Tag Manager itself does not process any personal data and does not store any such information. It is used exclusively to manage scripts and tags that are activated on the basis of your consent in accordance with the General Data Protection Regulation (GDPR).

Please note that by using third-party tools via the Google Tag Manager, data may be transmitted to external service providers - in particular to Google LLC. Further information on data processing by Google can be found in Google's privacy policy: policies.google.com/privacy.

You can change your consent to data collection at any time or revoke it via our cookie settings. Further details on the processing of your data, please refer to our company's own privacy policy.

7. Marketo

7.1 Description and scope of data processing

SEEBURGER uses services of Marketo EMEA Limited, Cairn House South County Business Park, Leopardstown, Dublin 18 Ireland ('Marketo'), such as sending our newsletter, invitations to webinars and events, the registration for participation of SEEBURGER Academy training as well as downloading information about our company and products ('digital services').

When sending emails, Marketo evaluates your user behavior on our behalf. For this evaluation, the emails sent contain so-called web beacons, also known as tracking pixels. These single-pixel image files allow us to track your user behavior.

We record when you read our emails, which links you click in them and draw conclusions about your personal interests. We link this data to actions carried out by you on our website (see also Section 7.2). Marketo stores the information collected in this way on its server in the European Union or the European Economic Area (EU or EEA). Tracking is not possible if you have disabled the display of images in your email program by default. If you display the images manually, the above tracking takes place.

If you use one of our digital services for which you have completed the registration process (for example, our newsletter), Marketo will also assist us in analyzing your usage behavior on our website. For this purpose, a text file (cookie, see also paragraph 5) is stored on your computer, which enables us to recognize you the next time you visit our website.

 

7.2 Purpose of data processing

We analyze how you use our website and other digital content such as videos, banners and downloads posted on our website. This allows us to tailor our offers to your individual needs, so that you receive less randomly distributed offers overall. We use the data obtained in this way to provide you with our digital services tailored to your interests.

 

7.3 Duration of storage

The cookie on your machine expires after 24 months. You may refuse the use of cookies by selecting the appropriate settings on your browser. SEEBURGER uses an external email validation service to ensure that email addresses can still be reached and that emails can still be delivered. If email addresses are no longer reachable, they are deleted from the corresponding repositories at SEEBURGER.

 

7.4 Scoring and user rating

Our website uses a scoring system to personalize the user experience and provide relevant content. This system scores and categorizes users based on a variety of factors, including your browsing behavior on our website, interactions, and preferences. We may also use information from external sources to gain a more complete understanding of your preferences and interests.

The criteria and weightings that go into our scoring system can be varied and are continually adjusted to ensure the accuracy and relevance of the scores. This scoring allows us to provide personalized recommendations and content to optimize your experience on our website.

 

7.5 Right of information, objection and revocation

If you register for one of our digital services and provide personal data via a registration form in this connection, we will obtain your declaration of consent. In it you agree to the extent described there with the data processing in the context of the use of our digital services, such as newsletters, invitation to webinars and events and associated analysis of your user behavior as described in this section. As a user you have the possibility to cancel the registration or change the data stored about you at any time. 8. Lead Forensics

SEEBURGER uses Lead Forensics, a B2B sales and marketing enablement tool. It is operated by Lead Forensics, UK Headquarters, Communication House, 26 York Street, London, W1U 6PZ, UK.

The Lead Forensics tool uses a tracking code for identifying businesses visiting our websites based on their business IP addresses. This is not the same as cookies. The Lead Forensics tracking code only provides information that is readily available in the public domain. It does not, and cannot, provide personal or sensitive data regarding who has visited our website. Under no circumstances will the data be used for the personal identification of an individual visitor. If IP addresses are collected, they will be anonymised immediately after collection. The information generated by the Lead Forensics tracking code is transmitted to the Lead Forensics tool and processed and stored in the UK within a secure environment.

The Lead Forensics tool does not provide us with the IP addresses. It provides us information on what companies have visited our website, the date and duration of their visit, and the web pages that they visit. This information allow us to analyse the use of our website and eventually contact those companies about their experience or for sales purposes. As an international company, to be able to guaranty you the best service, we transmit this data to our subsidiaries and distributors as far as necessary. Beyond this purpose, there is no transmission of personal information to third parties.

9. Registration through Contact Form

9.1 Description and scope of data processing

On our website, we offer users the opportunity to register by providing personal data though the contact form in order to obtain additional information or register for participation of SEEBURGER Academy training. The data is entered into a contact form and transmitted to us.

In addition to the data already mentioned, we collect first name, last name, job title, company, industry, department, country, title, telephone and email address. In the course of the registration process, the user's consent to the processing of this data is obtained.

 

9.2 Purpose of data processing

A registration of the user is necessary for the provision of certain content and services on our website as well as in the SEEBURGER Academy. The collection of the user's email address serves to deliver download links and coordinate training and event participation.

The collection of other personal data as part of the registration process serves to prevent misuse of the services or the email address used.

 

9.3 Duration of storage

The data will be deleted as soon as it is no longer needed to achieve the purpose for which it was collected. This also applies for data collected during the registration process if the registration on our website is cancelled or changed or if you as a user of our newsletter have indicated through newsletter opt-out (see also paragraph 9) that you do not wish to receive further information on SEEBURGER products and services. SEEBURGER uses an external email validation service to ensure that email addresses can still be reached and that emails can still be delivered. If email addresses are no longer reachable, they are deleted from the corresponding repositories at SEEBURGER.

 

9.4 Right of information, objection and revocation

10. Participation in events
(webcasts, training courses, seminars, etc.)

10.1 Event registration and implementation

We process data in order to prepare and carry out events. The type and scope of data processing depends on the event that has been booked. In principle, we process the following categories of personal data in order to organize an event: name, email address (private or business), telephone number (private or business), company, position and address (private or business). Without this data, we cannot process registrations and organize an event.

We process personal data for the following purposes in particular:

  • Sending of the registration confirmation and other documents for the event
  • Creation of a name badge for on-site events
  • Invoicing for chargeable events (e.g. training)
  • Forwarding of participant data (surname, first name and event attended) to the employer for invoicing purposes
  • Support before, during and after an event
  • Creation of the participation list
  • Forwarding the participation list to the speaker for optimal event preparation
  • Creation of a certificate of participation or a certificate of attendance

The legal basis for the described data processing is Art. 6 para. 1 lit. b GDPR (contract fulfillment, event execution) and Art. 6 para. 1 lit. f GDPR (protection of legitimate interests, based on our interest in preparing events in the best possible way).

 

10.2 Online events

We use tools and providers to carry out online events. When participating in an online event, our providers may collect personal data such as: user data (name, email address, profile picture), communication content (text, audio and video data; MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, and text file of all online event chats) and meeting metadata (topic, description, device information, IP address). In order to enable the video display and audio playback, data from the microphone and/or video camera is processed during the duration of an online event.

The legal basis for the data processing described is Art. 6 para. 1 lit. b GDPR (fulfillment of contract, event execution) and Art. 6 para. 1 lit. f GDPR (protection of legitimate interests, based on our interest in enabling and promoting cooperation between the participants of an event). In the case of a recording, this is done on the basis of Art. 6 para. 1 lit. a GDPR (consent).

 

10.3 Evaluation and surveys 

Surveys can be conducted as part of the evaluation of an event. It is important for us to receive comments and suggestions for improvement in order to ensure the quality of our events and to continuously improve them. Participation in a survey is voluntary. Participants' feedback with personal information will not be passed on to third parties. Data that we pass on to third parties is anonymized beforehand and is purely statistical in nature.

The legal basis for the data processing described is Art. 6 para. 1 lit. f GDPR (protection of legitimate interests based on our interest in ensuring the quality of our events and continuously improving our events).

 

10.4 Access to personal data

Within the SEEBURGER Group, access to personal data is only granted to employees who need it to carry out the tasks assigned to them. In the case of jointly organized events, SEEBURGER may share personal data of the registration with the partner / company in accordance with consent. The company involved will provide all legally required information about its processing purposes and how data subjects can exercise their rights. In addition, service providers or other persons who support us in the fulfillment of our tasks may be granted access to personal data, including:

  • Hosting service provider for the operation of our servers
  • Payment service providers and banks for the processing of payments
  • Service provider for the provisioning of a video conferencing system
  • Email dispatch service provider for sending emails in connection with your event participation and for sending mailings
  • Service provider for the provision of tools for conducting surveys and obtaining real-time feedback
  • Service provider for the provision of collaboration tools (digital whiteboard)
  • Speakers in preparation for an event
  • Employer for the purpose of invoicing

Service providers and speakers employed by us must meet special confidentiality requirements. They will only have access to your data to the extent and for the period of time required to fulfill their tasks.

 

10.5 Storage period

We store personal data until the purposes described in each case have been fulfilled, unless a longer retention period is required by law. As a rule, personal data is deleted as follows:

  • Participant lists are deleted or anonymized no later than two years after the end of an event.
  • Tax-relevant data (e.g. invoice data) is deleted after 10 years.
  • Deletion of newsletter data takes place after the withdrawal of consent.
  • Survey data that we have collected as part of an event will be deleted or anonymized after two years at the latest.

11. Chatbot Userlike

SEEBUGRER uses chat software from the company Userlike UG , Probsteigasse 44-46, 50670 Cologne, Germany. You can use the chat like a contact form to chat with our employees almost in real time. When you start the chat, the following personal data is collected, if you provide it: First name, surname, e-mail address.

Depending on the course of the conversation with our employees, further personal data may be collected in the chat and entered by you. The nature of this data depends largely on your enquiry or the problem you describe to us. The purpose of processing all this data is to provide you with a quick and efficient way to contact us and thus improve our customer service.

When you visit the website or the Customer Portal, the chat widget is loaded in the form of a JavaScript file from AWS Cloudfront. The chat widget technically represents the source code that is executed on your computer and enables the chat.

In addition, SEEBURGER stores the chat history for a period of 6 months. The purpose of this is to save you from having to make extensive comments on the history of your enquiry and to ensure continuous quality control of our chat service. Processing is therefore permitted in accordance with Art. 6 (1) (f) GDPR. If you do not wish this, you are welcome to inform us using the contact details below. We will then delete saved chats immediately.

The storage of chat data also serves the purpose of ensuring the security of our information technology systems. This is also our legitimate interest, which is why processing is permitted in accordance with Art. 6 (1) (f) GDPR.

12. Newsletter

12.1 Description and scope of data processing

You can subscribe to a free newsletter on our website. When registering for the newsletter, the data from the contact form is transmitted to us. The newsletter is sent out on the basis of the user's registration on the website.

In addition to the data already mentioned above, we collect first name, last name, job title, company, industry, country, title, telephone and email address.

During the registration process, your consent is obtained for subscribing to the newsletter and the necessary processing of the data.

 

12.2 Purpose of data processing

The user's registration on the website entails the collection of the user's email address which enables us to send out the newsletter.

The collection of other personal data as part of the registration process serves to prevent misuse of the services or the email address used.

 

12.3 Duration of storage

The data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected. The user's email address will therefore be stored continuously as long as the subscription to the newsletter is active and in the case of opt-out, to store the explicit unsubscribe. SEEBURGER uses an external email validation service to ensure that email addresses can still be reached and that emails can still be delivered. If email addresses are no longer reachable, they are deleted from the corresponding repositories at SEEBURGER.

 

12.4 Right of information, objection and revocation

The subscription to the newsletter can be cancelled by the user concerned at any time, this is so called opt-out. For this purpose there is a corresponding link in every newsletter.

This also makes it possible to revoke the consent to the storage of personal data collected during the registration process except the email address.

13. Right of Information, Revocation and Appeal

You have the right to obtain information about your personal data stored by us, get it corrected or erased partially or completely. In addition, you have the right to revoke or limit your consent of the use of your personal data at any time with effect for the future. Furthermore you have the right to get your personal data ported, where this is technically feasible. SEEBURGER will carefully examine your enquiry and clarify with you how it can best be fulfilled.

14. Social Media Plugins and Automated Decision Making

We currently neither use any social media plugins nor automated decision making and profiling.

15. Third Party Websites

Our data protection declaration does not apply to third-party websites that you access via hyperlinks on our websites. We ask you to check the data protection declarations used on the websites of the third party providers separately.

16. Data Protection and Data Security

Our employees and service providers are obliged to maintain confidentiality and data secrecy when handling personal data. Our data protection measures are regularly updated taking into account new technical developments.
